Case Analysis

Goldmines Diagnostic Pvt. Ltd. is a renowned company for the supply of medical equipment, they have a good reputation, resources, and manpower in the field of medical supplies. Mr. Chandra, owner of Reliance Suppliers entered into a contract with the Goldmines Diagnostic to purchase ECG machines and Defibrillators worth NRS. 500,000 by 1st June 2024. On the due date, Goldmines Diagnostic was unable to deliver the equipment and promised to supply it on 15th June 2024, Mr. Chandra rejected it and purchased the equipment from the other local vendor spending NRS. 700,000.

He then, approached Dr. Sandesh, director of the nursing home, on 5th June 2024 but the Director already acquired the items from another vendor, as Mr. Chandra was not able to deliver the medical equipment on 1st, June 2024. Dr. Sandesh, Director of a nursing home, alleged that Mr. Chandra breached the written contract and claimed NRS. 200,000 as a compensation from Mr. Chandra, which was denied by Mr. Chandra.

Questions:
